Terms of Service

Effective date: [TODO(DirectSolar): EFFECTIVE DATE]

These Terms of Service ("Terms") govern your use of the DirectSolar website and the concierge design and consultation service we offer through it. Please read them carefully before using the site or submitting a request.

1. Acceptance of these terms

By accessing this website or submitting a design request, you agree to be bound by these Terms and by our Privacy Policy. In these Terms, "DirectSolar," "we," "us," and "our" refer to [TODO(DirectSolar): LEGAL ENTITY NAME]. If you do not agree, please do not use the site or submit a request.

2. The service we provide

DirectSolar offers premium, white-glove solar and battery system design and installation consultation. When you submit a concierge request, our team reviews your property details and prepares a bespoke design proposal and follows up to discuss it with you.

Submitting a request or receiving a proposed design does not create a binding installation contract. Any installation is governed by a separate written agreement signed by both you and DirectSolar, which sets out the final scope, pricing, equipment, and terms.

3. Estimates & no guarantee

Any designs, system sizes, production figures, savings projections, payback periods, incentive amounts, timelines, and pricing presented before a signed installation agreement are preliminary estimates for illustration only. They are based on the information you provide and on assumptions that may change after a site assessment.

Actual results depend on factors outside our control, including your energy usage, roof and site conditions, weather, utility rates and policies, equipment availability, permitting, and applicable laws and incentive programs. DirectSolar does not guarantee any specific level of energy production, cost savings, tax credit, rebate, or financial outcome. Nothing on this site is tax, legal, or financial advice.

4. Your responsibilities

When using the site or submitting a request, you agree to:

7. Disclaimer of warranties

The website and any information or estimates provided through it are made available on an "as is" and "as available" basis. To the fullest extent permitted by law, DirectSolar disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, and does not warrant that the site will be uninterrupted, secure, or error-free.

8. Limitation of liability

To the fullest extent permitted by law, DirectSolar and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, savings, data, or goodwill, arising out of or relating to your use of the website or reliance on any pre-contract estimate or design, even if advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Indemnification

You agree to indemnify and hold harmless DirectSolar from any claims, damages, or expenses arising out of your misuse of the website or your breach of these Terms.

10. Governing law

These Terms are governed by the laws of the State of [TODO(DirectSolar): GOVERNING-LAW STATE], without regard to its conflict-of-laws principles.
